THE DANGEROUS PROXIMITY TEST

The dangerous proximity test focuses on whether the defendant was ‘dangerously close’ to completing the crime or ‘so near to the result that the danger of success is very great.’ Courts use this test to determine if the offender has gone beyond the preparation stage of the crime, and if s/he really attempted to do the crime.
